The two components
The National Institute on Aging describes advance directives as legal documents that take effect only if you cannot communicate your own wishes. In most states they combine two instruments. A living will records your preferences about life-sustaining treatment — ventilation, resuscitation, artificial nutrition and hydration, comfort care. A healthcare power of attorney (healthcare proxy) names an agent to make medical decisions the document doesn't anticipate.
State law governs the details; Delaware's health-care decisions statute is 16 Del. C. ch. 25, which sets execution requirements including two adult witnesses.
Choosing and preparing your agent
The agent matters more than the paperwork. Choose someone who understands your values, can act under pressure, and is willing to advocate against family or physician pressure if needed. Then actually talk to them: research consistently shows agents make more accurate decisions when they've discussed preferences in advance rather than guessing from a form.
Making it effective in practice
A directive locked in a drawer helps no one. Give copies to your agent, your physician (ask that it be added to your medical record), and your hospital on admission. Review it after any major diagnosis, divorce, a move to another state, or roughly every five years. A newer document supersedes older versions — destroy the outdated copies.
